1) Scope and Definitions of Services
This page defines the legal framework of cooperation between 'Nami Naghsh Printing Complex' and the customer. Our services include prepress, printing (digital and offset), post-press and finishing (cutting, lamination, binding, die-cutting, packaging), and delivery logistics. An order is finalized once technical specifications (quantity, final and open dimensions, paper/material type, coating, colors, schedule, delivery method) and final files compliant with declared standards are provided, and prepayment is made. We do not accept orders that conflict with national laws or third-party rights (including copyright or trademark infringement). Any changes after final approval of proof or invoice will be treated as a new order or amendment with separate cost and timeline. The customer acknowledges that printing is an industrial process with controlled tolerances, and acceptance of these tolerances is part of the agreement. For color-sensitive projects or special sizes, proofing and special conditions (extra cost, more time, dedicated printing) may apply to ensure expected quality. This framework is designed to ensure clarity and prevent disputes.
2) File Preparation and Technical Standards
The customer is responsible for the accuracy of file content (text, spelling, layout, images, and usage rights). Print files must be prepared in CMYK color space, images at 100% scale must have at least 300dpi resolution, and an appropriate bleed (usually 3mm) should be considered on all sides; additionally, a safe zone must be respected to avoid trimming essential elements. The preferred format is PDF/X with embedded fonts; however, other common formats may also be accepted if compatible with print standards. Files with low resolution, incompatible color profiles, or improper bleed/safe zones may be rejected or returned for correction. Requests for color conversion, resizing, redesign, or professional preparation will incur separate prepress service fees. Adherence to these criteria reduces errors, ensures consistent quality, and prevents later disputes, forming the basis for acceptance by the quality control unit.
3) Color Management, Matching, and Proofing
Due to differences in technologies and materials, exact color matching across all prints and reprints cannot be guaranteed; however, we manage tolerances based on process control standards (ISO 12647 and related guidelines). For special (Spot/Pantone) colors, note that many Pantone shades cannot be reproduced precisely in CMYK, and conversion has limitations; for color-sensitive projects, dedicated printing or hard proofing is recommended. By approving a digital/printed proof, the customer accepts the final evaluation benchmark. In gang-run printing, more noticeable color variation may occur compared to dedicated printing; in such cases, dedicated printing with special calibration is suggested. Minor variations in brightness, saturation, and hue within industrial tolerance are acceptable and not considered nonconformities.
4) Quantity Tolerance, Cutting, and Quality Control
Printing processes usually involve over/under delivery in quantities. A delivery tolerance of up to about 10% more or less than the ordered amount is common and acceptable in the industry, and invoices are issued based on delivered quantity; for precise quantities, higher costs and controlled waste apply. Cutting and folding processes inherently involve industrial tolerances, and respecting bleed and safe zones by the customer is critical. Final acceptance is confirmed upon inspection and signed delivery receipt; any defects must be reported within 7 working days with documentation for expert review. If a production error is verified, reprinting, correction, or fair compensation will be provided; however, defects arising from unsuitable files, expectations beyond industrial tolerance, or damage during external transport are not covered by the quality guarantee.
5) Production Schedule, Payments, Cancellation, and Returns
Production scheduling begins from the date of final proof/file approval and prepayment settlement. 'Urgent' orders depend on current capacity and may incur overtime costs. Delays caused by force majeure (power outages, widespread supply chain disruptions, emergency regulations, natural disasters) are beyond our responsibility. Cancellation after production begins is only possible with deduction of incurred costs and used materials. In gang-run or color-sensitive projects, cancellation after imposition or start of printing is not possible. Refunds are only issued in cases of verified production defects where correction is not possible. Special packaging and shipping costs are calculated separately, and transport damages fall under carrier terms. To reduce risks, sufficient buffer time is recommended before critical campaigns, and for urgent deadlines, dedicated printing or multiple proofing stages are advised.
6) Intellectual Property, Prohibited Content, and Promotional Use
By placing an order, the customer declares they own the rights to use the submitted files and visual assets (fonts, images, logos, graphic designs) and accepts responsibility for any third-party legal claims. Content that violates laws, third-party rights, or promotes hate, violence, pornography, or illegal advertising will not be accepted. Without written consent, customer designs and products will not be used for samples, website, or social media. With customer approval, brand names, photos, or videos of production may be published as case studies. The customer acknowledges that some commercial color libraries (e.g., Pantone) are provided under separate licenses and policies, and access/conversion in software may require licensed plugins or version upgrades; therefore, providing Pantone codes by the customer is a more reliable way to define custom colors.
7) Privacy, Data Retention, and File Archiving
Customer identity and contact information, order details, and uploaded files are only used for order processing, invoicing, support, and service improvement and will not be shared with third parties without legal requirement or explicit consent. We retain data only as necessary, following a reasonable lifecycle, and securely delete or anonymize after operational needs end. File archiving duration may vary based on business requirements, storage space, and customer needs; industry practice suggests some printers keep digital versions for several years, but permanent storage is not guaranteed. Customers may request file deletion (if permitted by contractual obligations and law). Our data retention policies follow best practices to minimize risks and ensure compliance.
8) Environment, Safety, Force Majeure, and Dispute Resolution
Nami Naghsh is committed to using standard raw materials, optimized processes, and responsible waste management where possible, and to offering green alternatives (recycled papers, eco-friendly inks) when feasible. Chemical handling and cutting tools follow safety protocols, and access to production areas is restricted to authorized personnel. Events beyond control such as natural disasters, major supply disruptions, unforeseen accidents, and emergency regulations are considered force majeure and suspend obligations until resolved. Disputes are first to be resolved through negotiation and mediation; otherwise, competent legal authorities will apply. Customers are advised to plan contingencies and buffer time for time-sensitive projects and state special requirements in writing before production begins for more predictable execution.
